Welcome to iAgentMY, a real estate professional productivity Web Application accessible through web browsers and designed for use across supported devices, including mobile phones, tablets, laptops, and desktop computers (the “Web Application”, “WA”, “Platform”, or “iAgentMY”).
iAgentMY is owned and operated by iAgentMY Sdn. Bhd. (20501036208 (1637618-U)), a company registered in Malaysia (“iAgentMY,” “we,” “us,” or “our”).
These Terms and Conditions (“T&C”) govern your access to and use of iAgentMY and its related services. By accessing, registering for, subscribing to, adding to your device home screen, or using iAgentMY, you agree to be bound by these T&C.
For the avoidance of doubt, iAgentMY is a web-based application. It is not a native mobile application and is not required to be downloaded from, distributed through, approved by, endorsed by, or affiliated with any mobile application marketplace, including the Apple App Store or Google Play Store.
Where supported by your browser or device, iAgentMY may be added to your device home screen for easier access. Such home screen access is a browser or device feature and does not change iAgentMY’s nature as a Web Application. Functionality, performance, display, notifications, home screen behaviour, and availability may vary depending on your device, operating system, browser, internet connection, and browser settings.
1. Acceptance of Terms
1.1 Contractual Agreement
These T&C constitute a legally binding agreement between you, the user (“you”), and iAgentMY.
1.2 Eligibility
iAgentMY is intended for individuals and professionals engaged in the real estate sector, including agents, negotiators, property managers, and related real estate service providers.
By using iAgentMY, you warrant that you are at least 18 years old or the age of majority in your jurisdiction, and that you have the legal capacity to enter into these T&C.
2. Services and Scope
2.1 Platform Purpose
iAgentMY is an agent-centric productivity Web Application designed to help real estate professionals manage property listings, internal sales and rental case tracking workflows, client leads, collaboration, and personal property marketing activities.
2.2 Core Services
iAgentMY provides features including, but not limited to:
- Creation and management of property listings;
- Collaboration with other users through Circles;
- Internal case tracking for sale and rent workflows;
- Automated reminders;
- Client database management, including leads and contacts;
- Management of My Page, a personal public webpage for sharing selected listings through a unique URL and individual listing links for social media distribution;
- On-demand generation of documents, including Listing PDFs, Inventory PDFs, and Case Summaries, collectively referred to as “Generated Documents.”
2.3 Web Application Nature
iAgentMY operates as a Web Application (WA). It is accessed through supported web browsers and does not require installation through any mobile application marketplace.
Adding iAgentMY to a device home screen, bookmarking it, saving a shortcut, or accessing it through a browser does not mean that iAgentMY is a native mobile application, nor does it imply distribution, approval, endorsement, or affiliation with any mobile application marketplace, device manufacturer, browser provider, or operating system provider.
2.4 Internal Use
The Case Tracking workflow is provided for your internal reference and productivity purposes only. It does not constitute a legal, binding, or enforceable document between any third parties unless separately reviewed, agreed upon, and signed externally by the relevant parties.
3. User Accounts and Subscriptions
3.1 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to notify iAgentMY immediately if you suspect any unauthorized access, account misuse, or security breach.
3.2 Subscription Plans
Access to certain features is limited by the subscription plan you select. You acknowledge and agree that your selected plan may include limitations such as:
- Listing and case tracking limits;
- Circle creation, joining, or access limits;
- Daily PDF export limits;
- My Page listing display limits;
- Access to selected advanced features, add-ons, or future premium functions.
3.3 Access Restoration
Deleting a listing or case, deleting a Circle, or exiting a joined Circle may free up an available slot under your plan.
Where applicable, the next eligible item may automatically gain full access, prioritized by earliest creation date, up to the allowed limit of your subscription plan.
3.4 Payment and Renewals
Subscription fees are billed in advance on a recurring basis according to your selected plan.
By subscribing, you authorize iAgentMY or its appointed payment service provider to charge your payment method for all applicable subscription fees, renewal fees, add-ons, taxes, and other charges.
Unless otherwise stated, all payments are non-refundable, including for unused subscription periods, downgraded plans, deleted content, inactive accounts, or early cancellation.
3.5 Plan Changes and Add-ons
iAgentMY may offer optional add-ons, upgrades, or additional service limits from time to time.
Any plan upgrade, downgrade, add-on purchase, or feature adjustment may be subject to separate pricing, billing cycles, usage limitations, and availability.
3.6 Subscription Price Changes
iAgentMY may change its subscription plans, add-on pricing, feature limits, billing cycles, promotional offers, and pricing structure from time to time.
Unless required by applicable law, iAgentMY is not obligated to give existing users advance notice before any price change takes effect.
Updated pricing may apply to new subscriptions, renewals, upgrades, add-ons, plan changes, or continued use of paid services after the revised pricing becomes effective.
By continuing to use or renew any paid service after the new pricing takes effect, you agree to the updated pricing.
iAgentMY may choose to provide grandfathered pricing, promotional pricing, or transition arrangements to certain users, but is not required to do so.
4. User-Generated Content and Data
4.1 Ownership
You retain ownership rights to the data and content you upload, enter, create, or manage within iAgentMY, including property descriptions, images, contact information, client leads, listing details, case details, documents, and related materials (“User Content”).
4.2 Licence to iAgentMY
By submitting User Content, you grant iAgentMY a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to use, host, store, reproduce, process, display, transmit, and distribute your User Content solely for the purposes of operating, providing, maintaining, improving, securing, and promoting iAgentMY and its related services.
This licence allows iAgentMY to technically process and display your User Content within features such as My Listings, Circles, My Page, Generated Documents, and other platform functions.
4.3 Accuracy and Legal Compliance
You are solely responsible for the accuracy, legality, reliability, completeness, and appropriateness of all User Content.
You must ensure that your User Content, especially property listings, client information, shared Circle content, My Page content, and Generated Documents, complies with all applicable Malaysian laws, regulations, professional rules, industry standards, privacy requirements, and third-party rights.
You warrant that you have all necessary rights, licences, permissions, consents, and authority to upload, store, process, publish, share, or distribute such User Content through iAgentMY.
4.4 Property Listing Responsibility
iAgentMY does not independently verify the accuracy, ownership, availability, pricing, condition, location, specifications, images, legal status, or any other details of properties listed, shared, displayed, or exported by users.
You are solely responsible for ensuring that all property information is accurate, updated, legally permissible, and not misleading.
4.5 My Page Public Sharing
You acknowledge that listings published to My Page may be publicly accessible through unique URLs and may be shared through social media, messaging platforms, search engines, or other external channels.
You are solely responsible for deciding which listings and information are published to My Page. iAgentMY is not responsible for third-party access, copying, sharing, indexing, screenshots, misuse, or redistribution of content that you choose to publish publicly.
4.6 Circle Sharing
You acknowledge that content shared within Circles may be viewed by other members of the relevant Circle.
You are responsible for ensuring that you have the right to share such content and that the content does not contain confidential, unauthorized, misleading, infringing, or unlawful information.
You further acknowledge and agree that when you share a listing into a Circle, other members of that Circle may be able to use, repost, reshare, or publish the shared listing through their own iAgentMY features, including displaying the listing on their own My Page, where such listing may become publicly accessible through their My Page URL or individual listing links.
Once a listing or related content is shared into a Circle, iAgentMY is not responsible for how other Circle members use, copy, save, disclose, rely on, reshare, publish, or display that content, including any publication of such content on their own My Page or other external platforms.
You should only share listings or information into Circles if you are comfortable with the possibility that such content may be further shared, displayed, or made publicly accessible by other Circle members, subject to the available functions of iAgentMY.
4.7 Disclaimers in Generated Documents
You acknowledge that Generated Documents may contain disclaimers stating that they are generated from user-provided information, and that iAgentMY does not verify, guarantee, or warrant the accuracy or completeness of those details.
You agree not to remove, hide, alter, or misrepresent any disclaimer contained in Generated Documents.
5. Security and Data Integrity
5.1 Security Measures
iAgentMY uses SSL/TLS encryption for communication between the Web Application and server, and implements reasonable technical and organizational measures intended to safeguard data integrity and maintain system reliability.
However, no online platform, web-based service, browser-accessible system, or internet transmission can be guaranteed to be completely secure.
5.2 Browser, Device, and Internet Dependency
Because iAgentMY is a Web Application, its performance and certain features may depend on your browser, device, operating system, internet connection, cache settings, notification permissions, storage permissions, and other third-party technical factors.
iAgentMY is not responsible for limitations, errors, failures, or interruptions caused by unsupported browsers, outdated devices, browser restrictions, operating system changes, user settings, third-party service outages, or internet connectivity issues.
5.3 Critical Actions
Permanent or critical actions, such as deleting a listing or case tracking record, may be protected by a verification process, including but not limited to 2-Step Verification.
You agree to complete any required verification for such actions.
5.4 Backup
We implement routine data backup procedures. However, iAgentMY does not guarantee that any lost, deleted, corrupted, or unavailable data can be restored.
You are advised to maintain your own external backups of critical documents, property records, client information, and business data.
When a user intentionally deletes their data, related backup copies may also be permanently erased in accordance with iAgentMY’s data management procedures.
6. Prohibited Conduct
You agree not to use iAgentMY to:
- Violate any local, state, national, or international law or regulation;
- Upload, post, publish, share, or transmit content that is false, misleading, defamatory, obscene, unlawful, discriminatory, threatening, or infringing;
- Misrepresent property ownership, authority to market, property availability, price, condition, location, or transaction status;
- Upload or share content that infringes intellectual property rights, privacy rights, confidentiality obligations, or third-party contractual rights;
- Access, collect, copy, scrape, download, or misuse other users’ data outside the intended functionality of iAgentMY;
- Misuse data shared within Circles;
- Distribute viruses, malware, harmful code, or malicious actions targeting iAgentMY, users, servers, or third-party systems;
- Interfere with, disrupt, overload, reverse engineer, or compromise the security or operation of iAgentMY;
- Use iAgentMY for spam, unauthorized advertising, fraud, impersonation, phishing, or other deceptive activities;
- Attempt to bypass subscription limits, access controls, verification processes, or platform restrictions.
7. Termination
7.1 By You
You may stop using iAgentMY and terminate your account at any time, subject to any applicable subscription, billing, data retention, and cancellation terms.
7.2 By iAgentMY
We reserve the right to suspend, restrict, or terminate your account and access to iAgentMY, with or without prior notice, if we reasonably believe that:
- You have breached these T&C;
- You have failed to pay applicable fees;
- Your conduct threatens the security, integrity, reputation, or operation of iAgentMY;
- Your User Content may be unlawful, misleading, infringing, harmful, or inappropriate;
- Your account is being misused, compromised, or used for fraudulent purposes;
- We are required to do so by law, regulation, court order, authority, or payment service provider.
7.3 Account Inactivity and Deletion
iAgentMY may deem an account inactive and subject to deletion if you fail to log in for six consecutive months.
Before deletion, we will attempt to notify you via your registered email at least 30 days in advance.
Upon deletion due to inactivity, associated user data may be permanently removed and unrecoverable.
7.4 Effect of Termination
Upon termination or account deletion, your access to iAgentMY, including your listings, Circles, My Page, Generated Documents, client data, and case tracking records, may be suspended or permanently removed.
iAgentMY is not liable for any loss arising from suspension, termination, deletion, or loss of access in accordance with these T&C.
8. Limitation of Liability
To the maximum extent permitted by law, iAgentMY and its affiliates, officers, directors, employees, agents, suppliers, service providers, or licensors shall not be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, revenue, goodwill, business opportunity, use, data, listings, clients, leads, reputation, or other intangible losses arising from:
- Your use of or inability to use iAgentMY;
- Errors, inaccuracies, or omissions in User Content;
- Property listing disputes;
- Misuse of Circle-shared content;
- Public exposure of content through My Page;
- Generated Documents;
- Subscription limitations;
- Browser, device, internet, or third-party service issues;
- Unauthorized access to or use of your account;
- Data loss, deletion, corruption, or unavailability.
iAgentMY’s maximum cumulative liability for all claims relating to your use of iAgentMY shall not exceed the amount you paid to iAgentMY for services in the six months preceding the claim.
9. Disclaimer of Warranties
iAgentMY is provided on an “as is” and “as available” basis.
We do not warrant that iAgentMY will be uninterrupted, error-free, secure, compatible with all devices or browsers, or available at all times.
We do not warrant that any listing, Generated Document, reminder, case tracking record, Circle content, My Page content, or user-generated information is accurate, complete, lawful, updated, or suitable for any particular purpose.
You use iAgentMY at your own discretion and risk.
10. Changes to iAgentMY and These Terms
iAgentMY may update, modify, suspend, remove, or discontinue any feature, subscription plan, add-on, usage limit, pricing, or platform function from time to time.
We may also update these T&C from time to time. Where reasonably practicable, we will notify users of material changes through the platform, email, or other appropriate means.
Your continued use of iAgentMY after such changes take effect constitutes your acceptance of the updated T&C.
11. Governing Law
These T&C are governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law provisions.
Any dispute arising from or relating to these T&C, iAgentMY, or your use of the platform shall be resolved exclusively in the courts of Malaysia.
