iAgentMY Privacy Notice

This Privacy Notice explains how iAgentMY Sdn. Bhd. (202501036208 (1637618-U)) (“iAgentMY,” “we,” “us,” or “our”) collects, uses, discloses, stores, and protects information when you access or use iAgentMY, a real estate professional productivity Web Application accessible through supported web browsers and designed for use across supported devices, including mobile phones, tablets, laptops, and desktop computers.

In this Privacy Notice, iAgentMY may be referred to as the “Web Application”, “WA”, “Platform”, or “iAgentMY.”

For the avoidance of doubt, iAgentMY is a web-based application. It is not a native mobile application and is not required to be downloaded from, distributed through, approved by, endorsed by, or affiliated with any mobile application marketplace, including the Apple App Store or Google Play Store.

Where supported by your browser or device, iAgentMY may be added to your device home screen for easier access. Such home screen access is a browser or device feature and does not change iAgentMY’s nature as a Web Application.

By accessing, registering for, subscribing to, adding to your device home screen, or using iAgentMY, you agree to the collection, use, disclosure, storage, and processing of your information in accordance with this Privacy Notice.

1. Information We Collect

We collect information that allows us to provide, maintain, protect, support, and improve iAgentMY. This information generally falls into the following categories.

1.1 Information You Provide Directly

This information may be collected during account registration, subscription, support communication, and ongoing use of iAgentMY.

Account Registration Data

This may include:

  • Name;
  • Email address;
  • Phone number;
  • Login credentials;
  • Account profile information;
  • Company, agency, or professional details, where applicable.

Billing and Subscription Data

This may include information required to manage your subscription, billing status, plan type, add-ons, invoices, receipts, and payment records.

Payment method details may be processed by third-party payment service providers. iAgentMY may not directly store full card numbers or full payment credentials unless expressly stated and technically required.

Support and Communication Data

This may include information you provide when contacting us, such as:

  • Support requests;
  • Bug reports;
  • Feedback;
  • Inquiries;
  • Screenshots or attachments you choose to provide;
  • Communication history with iAgentMY.

1.2 User-Generated Content and Platform Data

This is the professional and business data that you upload, enter, create, manage, publish, or share through iAgentMY.

Listing Data

This may include:

  • Property addresses;
  • Location information or location pins;
  • Property photos;
  • Property descriptions;
  • Prices;
  • Property type;
  • Amenities;
  • Inventory lists;
  • Availability details;
  • Owner, landlord, purchaser, tenant, or related transaction information, where entered by you.

Case Tracking Data

This may include:

  • Sale or rental transaction status;
  • Important dates and deadlines;
  • Financial details, such as earnest deposits, booking amounts, agreed prices, rental amounts, or related transaction figures;
  • Solicitor, banker, co-agent, landlord, vendor, purchaser, tenant, or related party information;
  • Internal notes;
  • Case-specific reminders;
  • Sale and rental workflow records.

Client Database Data

This may include:

  • Client names;
  • Phone numbers;
  • Email addresses;
  • Inquiry details;
  • Property preferences;
  • Assigned labels;
  • Notes;
  • NRIC or identification numbers, where you choose to enter such information;
  • Other lead, prospect, or client-related information.

Collaboration Data

This includes listing content, messages, references, or other information you choose to share with other users through Circles.

My Page Public Data

This includes selected listings, profile details, contact information, images, property details, and other content that you choose to publish through My Page or individual listing links.

Generated Documents

This includes information used to generate documents such as:

  • Listing PDFs;
  • Inventory PDFs;
  • Case summaries;
  • Sale summaries;
  • Rent summaries;
  • Other documents generated based on User Content entered into iAgentMY.

1.3 Automatically Collected Information

When you access or use iAgentMY, we may automatically collect certain technical and usage information.

Device, Browser, and Access Information

This may include:

  • Device type;
  • Browser type and version;
  • Operating system;
  • Screen size and display settings;
  • IP address;
  • Language settings;
  • Time zone;
  • Approximate location derived from technical access data;
  • Referring URLs;
  • Browser storage or cache-related information;
  • Home screen access behaviour, where technically available.

Usage Information

This may include:

  • Access times;
  • Login activity;
  • Features used;
  • Pages or screens viewed;
  • Listings created, edited, shared, published, or deleted;
  • Circle activity;
  • My Page publishing activity;
  • PDF export activity;
  • Subscription and plan usage limits;
  • System interactions and workflow activity.

Technical Logs and Performance Data

This may include:

  • Error logs;
  • Crash reports;
  • Network activity;
  • Server logs;
  • Security logs;
  • Data synchronization status;
  • Performance data;
  • Browser compatibility information;
  • Loading, caching, and system response data.

1.4 Cookies, Browser Storage, and Similar Technologies

Because iAgentMY is a Web Application, we may use cookies, local storage, session storage, browser cache, authentication tokens, or similar technologies to:

  • Keep you logged in;
  • Maintain session security;
  • Remember preferences;
  • Improve performance;
  • Support home screen access;
  • Analyze usage;
  • Protect against fraud, abuse, or unauthorized access.

You may control or disable cookies and browser storage through your browser settings. However, doing so may affect the functionality, performance, or availability of certain iAgentMY features.

2. How We Use Your Information

We use the information we collect for the following purposes.

2.1 To Provide and Operate iAgentMY

We use your information to:

  • Create and manage your account;
  • Authenticate your login;
  • Provide access to iAgentMY features;
  • Manage your listings;
  • Manage your case tracking records;
  • Manage your client database;
  • Enable Circle collaboration;
  • Enable My Page publishing;
  • Generate documents;
  • Process subscriptions, plan limits, add-ons, invoices, and receipts.

2.2 To Generate Documents

We use the User Content you enter into iAgentMY to generate on-demand documents, including Listing PDFs, Inventory PDFs, Sale Summaries, Rent Summaries, Case Summaries, and other Generated Documents.

Generated Documents are based on information provided by users. iAgentMY does not independently verify the accuracy, completeness, legality, or reliability of such information.

2.3 To Enable Collaboration

We use your information to facilitate sharing and collaboration within Circles, including making selected Listing Data or User Content visible to Circle members according to your actions and platform settings.

2.4 To Enable Public Sharing Through My Page

When you choose to publish listings or information to My Page, we use and display the selected information publicly through your My Page URL and individual listing links.

This allows you to share your listings through social media, messaging platforms, websites, and other external channels.

2.5 To Communicate With You

We may use your information to send:

  • Service announcements;
  • Account notifications;
  • Subscription renewal notices;
  • Payment-related notices;
  • Security alerts;
  • Verification messages;
  • Case tracking reminders;
  • Product updates;
  • Support responses;
  • Administrative messages.

2.6 To Improve and Secure iAgentMY

We may use information to:

  • Analyze usage patterns;
  • Improve performance;
  • Enhance features;
  • Fix bugs;
  • Improve browser compatibility;
  • Monitor system reliability;
  • Detect abuse, fraud, or unauthorized access;
  • Protect the security and integrity of iAgentMY.

2.7 To Comply With Legal and Business Obligations

We may use information to:

  • Comply with applicable laws and regulations;
  • Maintain accounting, tax, billing, and business records;
  • Resolve disputes;
  • Enforce our Terms and Conditions;
  • Respond to lawful requests from authorities;
  • Protect our legal rights and interests.

3. Disclosure and Sharing of Your Information

3.1 We Do Not Sell or Rent Your Data

We do not sell or rent your Personal Data, Listing Data, Client Data, Case Tracking Data, or Platform Data to third parties.

We only disclose or share information in the ways described in this Privacy Notice.

3.2 Circles

Any Listing Data, User Content, or other information you choose to share within a Circle may be visible to members of that Circle.

You are responsible for the information you choose to share. iAgentMY is not responsible for how other Circle members may view, use, copy, save, disclose, rely on, redistribute, or further share content that you share within a Circle.

You further acknowledge that when you share a listing or related content into a Circle, other members of that Circle may be able to use, reshare, or publish such listing through their own iAgentMY features, including displaying the listing on their own My Page. Where this occurs, the listing or related content may become publicly accessible through that user’s My Page URL, individual listing links, social media sharing, messaging platforms, search engines, or other external channels.

You should not share confidential, unauthorized, inaccurate, misleading, personal, or sensitive information within Circles unless you have the necessary rights, consent, and authority to do so, and unless you are comfortable with the possibility that such information may be further shared or made publicly accessible by other Circle members through the available functions of iAgentMY.

iAgentMY is not responsible for any third-party access, copying, screenshots, indexing, sharing, downloading, misuse, redistribution, or continued availability of content that was originally shared by you within a Circle and later published or shared by another Circle member.

3.3 My Page and Public Sharing

When you choose to publish listings or information to My Page, the selected Listing Data and content may become publicly accessible through your unique My Page URL and individual listing links.

This may include listings created by you in My Listings, as well as listings shared to you through Circles, where iAgentMY’s available features allow such listings to be displayed on your My Page.

You are responsible for deciding which listings, information, images, contact details, descriptions, or other content you choose to publish publicly on My Page.

You further acknowledge that when you publish any listing or related content to My Page, such information may be viewed by anyone who accesses the link, including through social media platforms, messaging platforms, search engines, websites, or third-party sharing channels such as Facebook, TikTok, Rednote, WhatsApp, Instagram, Telegram, Google, or similar platforms.

If you publish a listing or content that was originally shared to you through a Circle, you are responsible for ensuring that you have the necessary rights, consent, and authority to make such listing or content publicly accessible.

iAgentMY is not responsible for third-party access, copying, screenshots, indexing, sharing, downloading, misuse, redistribution, reliance on, or continued availability of content that is published on My Page, even if such content is later removed from iAgentMY.

You should not publish confidential, unauthorized, inaccurate, misleading, personal, or sensitive information to My Page unless you have the necessary rights, consent, and authority to do so, and unless you understand that such content may become publicly accessible.

3.4 Service Providers

We may disclose information to third-party vendors, consultants, contractors, and service providers who perform services on our behalf, including:

  • Cloud hosting providers;
  • Database and storage providers;
  • Payment processors;
  • Email service providers;
  • SMS or messaging service providers;
  • Analytics and performance monitoring providers;
  • Customer support tools;
  • Security and fraud prevention providers;
  • Professional advisers, including legal, accounting, tax, or compliance advisers.

These service providers are only permitted to process information as necessary to perform services for us, subject to appropriate confidentiality, security, contractual, or legal obligations where applicable.

3.5 Legal and Compliance Disclosure

We may disclose your information if we believe in good faith that such disclosure is necessary or appropriate to:

  • Comply with applicable laws, regulations, legal processes, court orders, or lawful government requests;
  • Protect the rights, property, safety, or security of iAgentMY, our users, or others;
  • Investigate fraud, abuse, security incidents, or technical issues;
  • Enforce our Terms and Conditions or other agreements;
  • Respond to claims that any User Content violates the rights of third parties.

3.6 Business Transfers

If iAgentMY is involved in a merger, acquisition, restructuring, financing, sale of assets, transfer of business, or similar corporate transaction, your information may be transferred as part of that transaction.

Where reasonably practicable, we will ensure that the receiving party continues to handle your information in accordance with applicable data protection obligations.

4. Data Security and Integrity

We are committed to protecting your information and implement reasonable administrative, technical, and organizational safeguards intended to prevent loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction of information.

4.1 Encryption

Communication between the Web Application and our servers is secured using SSL/TLS data encryption.

4.2 Database Reliability

We rely on database architecture designed to support data reliability, consistency, and integrity.

4.3 Account and Access Protection

We may use security measures such as authentication controls, session management, access restrictions, verification processes, system monitoring, and security logs to protect accounts and platform data.

4.4 No Absolute Security Guarantee

Despite our efforts, no security measure, online platform, web-based service, browser-accessible system, or internet transmission can be guaranteed to be completely secure.

You are responsible for keeping your login credentials confidential and for taking reasonable steps to protect your account, browser, device, and internet connection.

5. Data Retention

We retain Personal Data, User Content, Platform Data, and related records for as long as your account remains active or as long as necessary to provide iAgentMY services.

We may also retain information where necessary to:

  • Comply with legal, tax, accounting, audit, and regulatory obligations;
  • Resolve disputes;
  • Enforce agreements;
  • Maintain business records;
  • Prevent fraud or abuse;
  • Protect the rights and security of iAgentMY and its users.

5.1 Account Closure

If you close your account, we may delete, anonymize, or retain certain information as required or permitted by law, contractual obligations, legitimate business purposes, or technical backup procedures.

5.2 Deletion of Listings and Case Records

Deleting a Listing or Case Tracking record may require verification, including but not limited to 2-Step Verification, to confirm that you wish to permanently remove that data from your account.

Once deleted, such data may no longer be recoverable.

5.3 Backup Copies

Deleted information may continue to exist temporarily in backup systems, logs, archives, or disaster recovery storage until such copies are overwritten or deleted in accordance with our data management procedures.

Where a user intentionally deletes data, related backup copies may also be permanently erased in accordance with iAgentMY’s retention and backup processes.

6. Your Responsibilities

You are responsible for ensuring that any personal data or business data you upload, enter, publish, share, or process through iAgentMY is collected and used lawfully.

This includes ensuring that you have obtained all necessary rights, permissions, authorizations, and consents from property owners, landlords, vendors, purchasers, tenants, clients, co-agents, solicitors, bankers, or any other individuals whose information you enter into iAgentMY.

You must not upload, store, publish, or share personal data, identification numbers, contact details, confidential information, or sensitive information unless you have a lawful basis and authority to do so.

7. Your Rights Under Malaysian PDPA

Subject to the Personal Data Protection Act 2010 (PDPA) and applicable Malaysian laws, you may have the right to:

7.1 Access

Request access to the personal data we hold about you.

7.2 Correction

Request correction of inaccurate, incomplete, misleading, or outdated personal data.

7.3 Withdraw Consent

Withdraw consent to the processing of your personal data, subject to legal, contractual, operational, and technical limitations.

Please note that withdrawing consent may affect our ability to provide certain features or services.

7.4 Limit Processing

Request that we limit the processing of your personal data in certain circumstances, where applicable under Malaysian law.

We may require you to verify your identity before processing your request.

8. Third-Party Links and Platforms

iAgentMY may allow you to share content to or through third-party platforms, websites, social media services, messaging applications, or external links.

Examples may include Facebook, TikTok, Rednote, WhatsApp, Instagram, Telegram, Google, or other third-party platforms.

We are not responsible for the privacy practices, content, security, policies, or actions of third-party platforms. Your use of third-party platforms is governed by their own terms and privacy policies.

9. Changes to This Privacy Notice

We may update this Privacy Notice from time to time to reflect changes in our services, technology, legal requirements, business operations, or data practices.

We will update the Effective Date at the top of this Privacy Notice when changes are made.

Where reasonably practicable, we may notify users of material changes through iAgentMY, email, or other appropriate means.

Your continued use of iAgentMY after any update to this Privacy Notice constitutes your acknowledgement of the updated Privacy Notice.
